Welcome to ArtMarket.pk — a curated marketplace and growth platform built to help artists build sustainable careers and help collectors discover original Pakistani art with confidence.

These Terms of Service ("Terms") govern your access to and use of ArtMarket.pk, including our website, marketplace, artist services, communication tools, transaction services, and related features (collectively, the "Platform").

By creating an account, listing artwork, purchasing artwork, communicating through the Platform, or otherwise using ArtMarket.pk, you agree to these Terms.

If you do not agree with these Terms, please do not use the Platform.

1. About ArtMarket.pk

ArtMarket.pk ("ArtMarket", "we", "us", or "our") is a Pakistan-focused art commerce and artist growth platform.

We help Artists present, promote, and sell their work while helping Buyers and collectors discover original artwork from artists they can trust.

Our services may include:

ArtMarket may curate, feature, promote, or decline to feature particular Artists or Artwork in order to maintain the quality, trust, and reputation of the marketplace.

2. Definitions

"Platform" means ArtMarket.pk, its website, systems, features, services, and related technology.

"ArtMarket" means the operator of ArtMarket.pk.

"Artist" means a person or entity that creates, owns, or has the legal right to sell Artwork through the Platform.

"Buyer" means a person or entity that uses the Platform to discover, inquire about, or purchase Artwork.

"Artwork" means an original artistic or creative work listed through the Platform.

"Order" means a purchase of Artwork made through the Platform and accepted through the applicable transaction process.

"Commission" means the fee charged by ArtMarket to an Artist in connection with an eligible completed sale.

"User" means any person using the Platform, including Artists and Buyers.

3. Eligibility and Accounts

You must be at least 18 years old to create an account or enter into a transaction through the Platform.

By registering, you represent that:

You may not impersonate another person, create an account using false information, or use another person's account without authorization.

ArtMarket may request additional information or documentation where reasonably necessary for identity verification, Artist verification, fraud prevention, payment processing, security, or compliance purposes.

4. Artist Standards

4.1 Authenticity and Ownership

Artists may only list Artwork that they created, own, or have the legal right to sell.

Counterfeit, forged, stolen, copied, unauthorized, or infringing Artwork is prohibited.

Artists are responsible for ensuring that their Artwork and listings do not violate another person's intellectual property, privacy, publicity, or other legal rights.

4.2 Accurate Listings

Artists must accurately represent their Artwork, including where applicable:

Images should represent the actual Artwork being offered for sale.

4.3 Pricing

Artists generally determine the selling price of their Artwork unless otherwise agreed with ArtMarket.

Applicable commissions, promotional fees, delivery charges, taxes, or other charges will be disclosed through the applicable Platform process.

4.4 Availability

Artists must keep Artwork availability accurate. An Artist must not accept an Order for Artwork that has already been sold, withdrawn, or is otherwise unavailable.

4.5 Fulfillment

Artists are responsible for properly packaging and preparing Artwork for delivery. Artists must dispatch Artwork within the applicable fulfillment period, provide tracking information where available, and promptly notify ArtMarket of material delivery issues or delays.

Artists may be responsible for losses or costs arising from inadequate packaging, inaccurate information, unreasonable delays, or failure to follow applicable fulfillment requirements.

4.6 Professional Conduct

Artists must communicate professionally with Buyers and other Users and must not use the Platform to harass, intimidate, deceive, or abuse others.

5. Buyer Standards

5.1 Purchases

Buyers must provide accurate information and complete payment using the payment methods made available through the Platform.

An Order may be cancelled where Artwork is unavailable, payment cannot be verified, fraud or suspicious activity is detected, a material listing error exists, or the transaction cannot reasonably be fulfilled.

5.2 Delivery Information

Buyers are responsible for providing accurate delivery information. ArtMarket is not responsible for delivery failures caused by incorrect or incomplete information supplied by a Buyer.

5.3 Inspection

Buyers should inspect Artwork promptly after delivery and report qualifying damage, discrepancies, or other issues within the period specified in the Refund & Return Policy.

6. Artist Verification and Curation

ArtMarket may review Artist information, documentation, portfolios, transaction history, references, and other information when determining whether an Artist qualifies for verification or participation in particular Platform programs.

A "Verified Artist" designation indicates that the Artist has completed ArtMarket's applicable verification process. It is not an absolute guarantee of every statement made by the Artist or every characteristic of their Artwork.

ArtMarket may remove or suspend verification where information becomes inaccurate, circumstances change, or the Artist no longer meets applicable standards.

7. Commission and Platform Fees

ArtMarket may charge Artists a commission on eligible completed sales. The applicable rate will be disclosed through the Artist dashboard, registration process, Artist agreement, or applicable promotional program.

Commission rates may vary according to Artist tier, promotional arrangements, category, campaign, or other commercial terms. ArtMarket may change its fee structure by providing reasonable notice before changes apply to future transactions.

8. Payments and Payouts

Payments may be processed through ArtMarket and/or third-party payment, banking, or financial service providers. The handling, settlement, verification, and timing of funds may depend on the applicable payment method and payment provider.

ArtMarket may delay or withhold a payout where reasonably necessary to investigate a dispute, refund request, chargeback, fraud concern, payment issue, identity verification issue, or legal or regulatory requirement.

Subject to applicable policies, Artist payouts will generally be processed according to the payout schedule displayed in the Artist dashboard or otherwise communicated by ArtMarket.

9. Returns, Refunds, and Buyer Protection

ArtMarket aims to provide Buyers with a reliable purchasing experience while recognizing that original Artwork is often unique and cannot be treated like mass-produced merchandise.

Qualifying returns and refunds are governed by the ArtMarket Refund & Return Policy. Buyers and Artists agree to cooperate with reasonable investigations into damage, misrepresentation, delivery issues, suspected fraud, or other transaction disputes.

10. Disputes

ArtMarket may facilitate the resolution of disputes between Buyers and Artists. We may review listing information, photographs, messages, transaction records, delivery information, tracking records, reviews, and other relevant evidence.

Where appropriate, ArtMarket may issue or facilitate a refund, adjust a payout, require a return, suspend an account, remove Artwork, or take another reasonable Platform-level action. Nothing in these Terms removes rights or remedies that cannot lawfully be excluded under applicable law.

11. Off-Platform Transactions

Users must not use ArtMarket to identify potential Buyers or Artists and then intentionally move transactions outside the Platform for the purpose of avoiding applicable fees, transaction protections, or Platform processes. Attempting to circumvent the Platform may result in suspension or termination of an account.

13. Intellectual Property

Artists retain ownership of their Artwork and associated intellectual property rights, subject to rights transferred through a completed sale or other applicable agreement.

By listing Artwork on ArtMarket, an Artist grants ArtMarket a non-exclusive, worldwide, royalty-free license to display, reproduce, resize, format, distribute, and promote images and information relating to the Artwork for purposes including operating, marketing, advertising, and promoting the Platform, Artist, and Artwork. This license does not transfer ownership of the Artwork to ArtMarket.

ArtMarket's website, branding, logos, software, design, text, graphics, systems, and other Platform materials remain the property of ArtMarket or their respective licensors.

14. Reviews and User Content

Users may submit reviews, ratings, photographs, comments, messages, and other content through the Platform. Users must ensure that submitted content is truthful, lawful, non-infringing, and not abusive, fraudulent, defamatory, or misleading.

By submitting content to ArtMarket, you grant us a non-exclusive, royalty-free license to host, display, reproduce, and use that content for operating, improving, and promoting the Platform. ArtMarket may remove content that violates these Terms or threatens the trust, safety, or integrity of the Platform.

15. Marketing and Promotion

ArtMarket may promote selected Artists and Artwork through its website, social media, advertising, email, newsletters, editorial content, partnerships, exhibitions, and other marketing channels. Participation in the Platform does not guarantee impressions, inquiries, followers, leads, or sales.

16. Platform Availability

We work to keep ArtMarket reliable and available, but we do not guarantee that the Platform will always be uninterrupted, error-free, secure, or available. We may temporarily suspend access for maintenance, security, upgrades, investigations, emergencies, or operational reasons.

17. Third-Party Services

ArtMarket may rely on third-party providers for payments, delivery, hosting, analytics, communications, advertising, security, and other services. Third-party services may be subject to their own terms and privacy policies.

18. Account Suspension and Termination

ArtMarket may suspend, restrict, or terminate accounts where we reasonably believe that a User has violated these Terms, engaged in fraud, provided materially false information, listed prohibited Artwork, abused another User, compromised Platform security, or materially harmed the integrity or reputation of the Platform.

19. Disclaimer

ArtMarket takes reasonable measures to support verification, accurate listings, and trustworthy transactions. However, except where expressly stated or required by applicable law, we do not guarantee that every Artist, Artwork, listing, transaction, delivery, or User will meet every Buyer's expectations. Artwork should not be purchased solely on the expectation of future financial appreciation or investment return.

20. Limitation of Liability

To the maximum extent permitted by applicable law, ArtMarket will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Platform. Where legally permissible, ArtMarket's aggregate liability arising from a particular transaction will be limited to the amount actually paid to ArtMarket in connection with that transaction.

21. Indemnification

To the extent permitted by applicable law, Users agree to indemnify and hold ArtMarket and its officers, employees, contractors, and representatives harmless from claims, losses, liabilities, damages, costs, and expenses arising from their violation of these Terms, unlawful conduct, infringement of another person's rights, Artwork or listings, or misuse of the Platform.

22. Privacy

ArtMarket collects and processes personal information in accordance with its Privacy Policy, which forms part of the Platform's legal framework.

23. Electronic Communications

By using ArtMarket, you consent to receiving electronic communications relating to your account, orders, payments, security, customer support, and Platform services.

24. Changes to These Terms

We may update these Terms from time to time. Where changes are material, we may provide notice through the Platform, email, or another reasonable method. Continued use of the Platform after the effective date constitutes acceptance to the extent permitted by applicable law.

25. Governing Law and Jurisdiction

These Terms are governed by the laws applicable in Pakistan. Disputes relating to these Terms or the Platform shall be subject to the jurisdiction of courts having lawful jurisdiction over the matter.

26. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be modified or interpreted to the minimum extent necessary, and the remaining provisions will continue in effect.

27. Entire Agreement

These Terms, together with the Privacy Policy, Refund & Return Policy, Artist policies, and other terms expressly incorporated into the Platform, constitute the agreement governing your use of ArtMarket.
